Through the website https://www.cocinoNcasa.es (hereinafter the WEBSITE), cocinoNcasa:

• It provides full information regarding the weekly home delivery service for food and recipes that is available.
• It allows unregistered users to choose and pay for their first subscription to the services offered.
• It makes a platform available to users for managing and paying for subscriptions and orders, accessible only via username and password.
• It establishes various contact channels for any type of request or issue users may have regarding the services offered on the WEBSITE.

3. ACCEPTANCE OF WEBSITE TERMS OF USE

The use of this WEBSITE is governed by the following General Conditions of Use (hereinafter, GENERAL CONDITIONS).

Access to this WEBSITE, official social media profiles, and/or the information contained therein is entirely free of charge, without prejudice to any costs arising from the telephone connection and the means used to establish that connection.

Such acts of exploitation may only be carried out with the prior, express, and written authorization of cocinoNcasa and provided that explicit reference is made to cocinoNcasa’s ownership of the aforementioned intellectual and industrial property rights.

By using the WEBSITE and/or the contents of the WEBSITE, the USER acquires no rights thereto, but may simply use them in accordance with the terms agreed upon in these GENERAL CONDITIONS.

cocinoNcasa does not offer or market—either directly or through third parties—the information, content, products, and/or services available on the LINKED SITES, nor does it approve, supervise, or control in any way the content, products, services, or any material of any nature found therein; the USER assumes sole responsibility for navigating such sites.

8. RESPONSIBILITY

cocinoNcasa will at all times endeavor to provide products and/or services of the highest possible quality. Notwithstanding the foregoing, cocinoNcasa disclaims all liability and/or responsibility for any damages or losses arising from:

1. Failures, interruptions, or damage caused by system breakdowns, malware viruses, interference or disconnections, or by the malfunction of the service or the WEBSITE.
2. Regarding information and content stored—including, but not limited to, that found in forums, chats, blog generators, comments, social networks, or any other medium allowing third parties to independently publish content on the website— cocinoNcasa will actively cooperate in the removal or, where applicable, the blocking of any content that may violate national or international laws, infringe upon the rights of third parties, or contravene public morals or public order. In any event, cocinoNcasa shall not be held liable for the illegitimate actions of third parties by any means, nor for improper or inappropriate conduct by the USER, nor for any consequences arising from actions or negligence beyond its control that may—directly or indirectly—affect the servers and other computer equipment belonging to the USER or third parties.

The USER agrees to indemnify and hold harmless cocinoNcasa, its subsidiaries, affiliates, officers, collaborators, and/or employees from any claims or demands—including reasonable attorney’s fees—brought by third parties arising from the USER’s improper or unauthorized use of the WEBSITE and/or the products and/or services offered, or from the USER’s violation of the GENERAL TERMS AND CONDITIONS, PRIVACY POLICY, and/or COOKIE POLICY, as well as from any violation of applicable laws or rights.

cocinoNcasa merely provides the USER with the WEBSITE for the purpose of publicizing and promoting cocinoNcasa’s activities, services, and products. The USER is, therefore, solely responsible for the proper use of the WEBSITE and for ensuring that such use complies with the GENERAL TERMS AND CONDITIONS, the PRIVACY POLICY, the COOKIE POLICY, and/or, where applicable, the TERMS OF CONTRACT.

9. NULLITY AND INEFFECTIVENESS OF CLAUSES

10. APPLICABLE LAW AND JURISDICTION

For any issue or dispute that may arise regarding the WEBSITE, its content, or the services contracted, the USER and cocinoNcasa—expressly waiving any other venue to which they might otherwise be entitled—expressly submit to Spanish law and the jurisdiction of the Spanish courts, specifically the courts of Valencia, unless applicable law mandatorily dictates a different venue or governing law.

Specifically, this waiver shall not apply to USERS considered to be final consumers; in such cases, the jurisdiction of the courts and tribunals of the user’s place of residence shall apply.
